National Ordinance of June 8, 1993
Concerning provisions related to the operation of games of chance on the international market through service line services and amending the Criminal Code of the Netherlands Antilles.
IN THE NAME OF THE QUEEN!
The Governor of the Netherlands Antilles,
Considering:
- That it is desirable to enable the operation of games of chance on the international market through service line services;
- That the Criminal Code of the Netherlands Antilles, as amended, last by the national ordinance of December 22, 1989 (P.B. 1989, no. 94), also needs to be further amended in this regard;
Having heard the Council of Advice and with the joint consultation of the States, has established the following national ordinance:
Article 1
- The Governor is authorized to grant a license for the operation of games of chance on the international market through service line services.
- A license for the establishment and operation of these games of chance is only granted to legal entities established in the Netherlands Antilles.
Article 2
- Conditions may be attached to the license referred to in Article 1, paragraph 1.
- These conditions may relate, among other things, to: a. How the activities are carried out by the legal entity;
b. The method of handling the prize system;
c. The method of prize payments;
d. Government supervision to be exercised;
e. Financial guarantees to be provided by the legal entity.
Article 3
- The license referred to in Article 1, paragraph 1 is non-transferable.
- By national decree, the annual fee for the license referred to in Article 1, paragraph 1 shall be determined.
Article 4
A license granted under Article 1, paragraph 1 may be revoked or temporarily suspended by the Governor if one or more of the conditions attached to the license are not observed.
Article 5
The Criminal Code of the Netherlands Antilles, as amended, is further amended as follows:
The introduction of Article 266 shall read:
With imprisonment of up to two years or a fine of up to six thousand guilders, anyone is punished who, without a license pursuant to Articles 1 and 1a of the National Ordinance on Games of Chance 1948, or pursuant to an island ordinance replacing said Articles 1 and 1a, or pursuant to a license under Article 1, paragraph 1, of the National Ordinance on Offshore Games of Chance.
Article 6
- This national ordinance shall enter into force on the day after its publication in the Official Bulletin.
- It may be cited as the National Ordinance on Offshore Games of Chance.
